Service Agreement


Under this service agreement, Surreal Photo & Cinema will be referred to as "the Photographer", and the party requesting services will be known as "the Client".


In regards to the contracted services the Photographer will be providing the Client, the Service Agreement clearly outlines all responsibilities and commitments, as well as expected contributions, in order to achieve a professional relationship.


This Service Agreement shall be governed by and construed in accordance with the domestic laws of the State of Texas without giving effect to any choice or conflict of law provision or rule that would cause the application of the laws of any jurisdiction other than the State of Texas.


SERVICE INFORMATION


All general sessions, typically deliver anywhere between 70 – 140 “straight out of camera” images per hour reserved. All original images will be branded, accompanied by certain restrictions. If the client purchased any of the available photography packages, the Client will then choose favorites of the original photos for final editing, if the selected package includes edited images. Once final editing is complete, the print ordering process will begin, if applicable.


TURN-AROUND TIME


(A)For proofs of original images, the approximate turnaround time would be up to 5 business days. (B)For post produced images, if applicable, the approximate turnaround time would be up to 5 business days. (C)For print deliveries, if applicable, the approximate turnaround time would be between 7-14 business days. Turnaround times may be delayed. In this case, the Client may contact us in order to receive a new turnaround time.


DELIVERY METHODS


Proofs will be presented and delivered via an email with a link to an online gallery where the client will be able to download, favorite and share their images freely. Once favorites are finalized and are ready for viewing, if applicable, a new email will be sent out with instructions on how to place a print order, if applicable. Prints will be delivered to the clients specified address. A copy of the images will be delivered via mail in a USB if applicable.


SELECTING YOUR IMAGES FOR POST PRODUCTION (IF APPLICABLE)


Once the email with the link to the online gallery is received, the client’s gallery will hold the entire session’s images. To favorite and select an image for post-production editing, select the desired image and then select the heart icon. A prompt will appear to input an email address and will be required to be filled out. Repeat the process for the remaining photos. If the client would like to have more photos edited than the amount included, a $10 fee per additional photo will be charged. The Photographer, may replace any of the selected images based on his/her professional opinion.


CLIENT PARTICIPATION


DRESS CODE


The Client is fully aware of the impact their attire will have on the given images and will attempt to dress accordingly to the outlined expectations they have given the Photographer in order to achieve the desired images. The Client is fully responsible to make sure her attire is ready to shoot once arriving to the scheduled session and any accessories or articles of clothing that are not desired should be removed prior to beginning.


PUNCTUALITY


The Client is responsible for arriving at the time reserved. If the Client arrives late, the Photographer is not responsible for providing additional time in order to compensate the lost time. The remaining time, however, will be honored. If the Client fails to respond 15 minutes prior or after the scheduled start time and is running late, the Photographer may leave at their own discretion. The appointment may be rescheduled however, a $50 fee will be applied.


TIME OF DAY


The Photographer will provide his/ her recommendation of the best time available of the day suitable for the given session. If the Client rejects the time for another time due to any given reason, the Client is fully aware of the impact it could have on the quality of the content.



WEATHER


If, during the scheduled day of the session, bad weather, undesirable weather, or any other form of inconvenience caused by the condition of the day arises, in accordance to the photographer’s professional opinion, the Photographer reserves the right to reschedule the session.


PROFESSIONAL RESPONSIBILITY


The Client is aware of the professional responsibility the Photographer has during their photo session and agrees to allow full creative control over the time allotted. If during the session however, the Photographer asks for the Client’s input the client may comment. The Client does have a right to address concerns during the session. The Photographer has a right to reject any idea given by the Client per his/ her professional decision. If for any reason the Photographer reaches a conclusion that declares the Client be too difficult to collaborate with, the Photographer has the full authority to cancel and refund the Client, minus the booking fee.


RESCHEDULING


While Clients are welcomed to reschedule their sessions freely, there are some restrictions. Clients may reschedule their sessions no sooner than 120 minutes from their scheduled session. Rescheduling is based on availability. If the rescheduling guidelines are not met, the Client may face a $35 fee, at the photographer’s discretion. The Photographer reserves the right to reschedule sessions based on his/ her professional opinion. Please note, your session may be rescheduled on the same day to a different hour of the day depending on the Photographer’s professional opinion. Such adjustment usually only occurs on a 30-minute difference and the Client will be notified of suggested schedule adjustment prior. If the Client rejects the proposed schedule adjustment, the Client is fully aware of the impact it could have on the quality of content.


PUBLISHING AGREEMENT


Any content from the scheduled session can and will be used in the Photographer's published website and social media outlets. The Client understands the importance of published work and will agree to any publications made on behalf of the photographer. If there is any content, in part, the Client wishes to retain from publication, the Photographer will review the request and approve based on the validity of the concern. In such case, only the content under concern will be held private.


PAYMENTS


SESSION PAYMENT


The Client understands the full session’s payment is due at the end of the scheduled work day. If the session is not paid in full by the end of the session’s day, no additional work will be delivered until the session’s balance has been payed off.


ADMISSION FEES


Any and all applicable admission fees instituted by any third party vendors fall directly under the Client’s responsibility. The client will be responsible for any third-party fees for themselves, the Photographer, and the Photographer’s assistant.


REFUNDS, EXCHANGES, PAYMENTS MADE, & DEPOSITS


All deposits and/ or payments made are nonrefundable unless service severance is issued on behalf of the Photographer. All deposits and/or payments made are used to secure and resolve any promised dates and services. Deposits and/or payments made are secured towards specific packages. Should a change in package resulting in less time being reserved occur after the deposit is submitted, a $35 fee will be applied to the client’s total balance. Exchanges and/or credit for different services/products offered are handled on a case by case basis per our user agreement. In the event a refund is requested within 12 hours of the initial booking and services have not yet been rendered, the request will be subject for review based on a case by case basis. Should the request for a refund within 12 hours of initial booking without services being rendered be approved, the refund will be processed within 5-10 business days. Any client cancellations will not qualify for a refund, and any payments, pre-payments, and/or deposits made are considered as liquidation damages.


FORCE MAJEURE


The Force Majeure clause is a provision that allows a party to suspend or terminate the performance of its obligations when certain circumstances beyond their control arise, making performance inadvisable, commercially impracticable, illegal, or impossible. If either the photographer or the client is unable to accommodate this agreement in regards to the session date due to unforeseen circumstances that is out of their power, the date will be rescheduled accordingly with both parties.


The client upon submitting a payment agrees that if any of these outlines are not respected or met, the quality of work may be affected.
